AFFIDAVIT OF FREE WILL OR AFFIDAVIT OF SUI-JURIS (SPECIMEN-DRAFT)

In Karachi, the Affidavit of Free Will (or Affidavit of Sui-Juris) is the most critical document for a bride during a court marriage. It serves as her formal legal declaration that she is an adult, of sound mind, and is entering the marriage without any kidnapping, coercion, or duress

Below is the standard legal format used in Karachi for 2026.

Important Requirements for 2026

  • Stamp Paper: This must be printed on a non-judicial stamp paper of at least PKR 100 (values may vary slightly based on the latest Sindh Revenue updates).
  • Attestation: It must be attested by an authorized Oath Commissioner or a Notary Public in Karachi.
  • Photograph: In 2026, it is standard practice to paste a recent passport-sized photograph of the bride on the top corner of the affidavit, which is then cross-signed by the attesting officer.

Why this document is vital:

If your family files a kidnapping case at a Karachi police station, your lawyer will present this Affidavit and your NADRA Marriage Certificate to the Investigating Officer (I.O.) or the Magistrate. Under Section 164 CrPC, the Magistrate will record your statement, and this affidavit will serve as the primary evidence to quash the false case.
